EPA Delays PFAS Reporting Start, Updates Disposal Guidance

The U.S. Environmental Protection Agency has issued two recent PFAS updates with compliance relevance for manufacturers, importers, waste managers and other companies handling PFAS-containing materials.
On April 9, EPA finalized a change to the start of the reporting period for the PFAS reporting rule under Toxic Substances Control Act section 8(a)(7). The agency said the reporting period will move from April 13, 2026, to 60 days following the effective date of EPA’s forthcoming revision to the PFAS 8(a)(7) rule.
According to EPA, TSCA section 8(a)(7) requires anyone that manufactured or imported PFAS in any year between 2011 and 2022 to report information related to chemical identity, uses, volumes made and processed, byproducts, environmental and health effects, worker exposure and disposal. EPA said it is reviewing the rule to ensure the agency obtains comprehensive and reliable information from manufacturers and importers.
EPA also issued updated interim guidance for the destruction and disposal of PFAS and PFAS-containing materials. The agency said the updated guidance reflects recent data and is intended to help states, utilities, waste handlers and local communities manage PFAS safely.
The guidance identifies three existing technologies that EPA said stand out for having lower potential for environmental PFAS release under site-specific conditions: Class I underground injection wells for long-term waste storage, Resource Conservation and Recovery Act-regulated hazardous waste landfills and hazardous waste combustors operating under certain conditions. EPA also said the guidance includes a new technology evaluation framework for emerging destruction and disposal tools.
EPA’s fact sheet states that the interim guidance does not establish requirements for PFAS destruction or disposal. The Federal Register notice says comments on the interim guidance are due June 29, 2026.
