New TSCA Resource May Affect Chemical Submissions

RadTech is encouraging members to review new EPA materials related to Confidential Business Information claims scheduled to expire under the Toxic Substances Control Act.
EPA released a publicly accessible list of TSCA CBI claims scheduled to expire between June 22, 2026, and July 31, 2026. The agency said it will refresh the list monthly as additional claims approach their expiration dates. EPA is required under TSCA section 14(e)(2)(A) to provide 60-day notice to submitters of expiring CBI claims.
Under TSCA section 14(e), most non-exempt CBI claims expire after 10 years unless the submitter requests and EPA approves an extension. If EPA does not receive an extension request at least 30 days before the claim expiration date, the agency is not required to safeguard the CBI from disclosure and the information may be made public without further notice to the submitter.
RadTech’s member alert encouraged companies with prior TSCA submissions or confidential chemical identity claims to review EPA’s list of expiring claims, check the TSCA Inventory for chemical identity claims, confirm Central Data Exchange account access and company contacts, and submit an extension request if needed.
Companies seeking to extend an expiring CBI claim must submit a “TSCA Section 14(e) CBI Claim Extension Request” through CDX no later than 30 days before the claim expiration date. EPA has also posted webinar materials explaining the CBI claim expiration process and how to request an extension.
