Wisconsin Reaches PFAS Settlement With Tyco Fire Products

The Wisconsin Department of Justice announced a settlement with Tyco Fire Products LP related to alleged PFAS violations in Marinette, Wisconsin.
Under the settlement, Tyco agreed to provide a $10 million payment to the state of Wisconsin, with funds to be deposited into the state’s PFAS Trust Fund. According to the Wisconsin DOJ, the payment is in addition to approximately $100 million the company has already spent to address PFAS contamination in the Marinette area.
As part of the agreement, Tyco will continue to provide replacement wells, conduct required monitoring and reporting, and implement additional measures for long-term remediation of the agreed-upon area. The settlement also requires the company to provide deep drinking water wells for existing plots within an agreed-upon area, with the offer remaining valid for 20 years.
The lawsuit, filed by Wisconsin Attorney General Josh Kaul in 2022, alleged that Tyco violated the state’s Spills Law by failing to notify the Wisconsin Department of Natural Resources of a PFAS discharge and failing to investigate and remediate PFAS contamination at and around the Fire Technology Center in Marinette.
The agreement will go into effect once approved by the court. A separate 2022 lawsuit involving Tyco and other manufacturers related to PFAS contamination in Wisconsin remains pending.
