Evonik Prevails in Dual Patent Challenges

Evonik announced that it has prevailed in two separate patent disputes, securing legal protection in Europe and the United States for its 3-stage biogas upgrading process using SEPURAN® Green membranes.
In final decisions, the European Patent Office upheld Evonik’s EP3240620 B1 patent and the United States Patent and Trademark Office upheld Evonik’s US 10,471,380 B2 patent. In both cases, the respective boards of appeal dismissed all requests for invalidation filed by other parties.
According to the company, the decisions confirm legal protection for its 3-stage process across key global markets, including the European Union and the United States.

Evonik stated that its patented process is used to upgrade raw biogas composed primarily of biomethane and carbon dioxide. The process can be implemented without a second compressor, reducing equipment complexity as well as overall energy use and operating costs.
When combined with Evonik’s integrated membrane technology and customer support, the company said the process enables efficient purification while addressing a range of operational requirements.
“We started in the biogas upgrading market more than 10 years ago,” said Markus Priske, director application technology gas separation membranes at Evonik. “There is increasing demand for very low-CO2, LNG-ready biomethane and an interest in very low methane slip. I am proud that this patent is able to offer cost-optimized solutions that address all these different trends.”
